“What 25 Years of Anti-SLAPP Motions Have Taught Us”

Code of Civil Procedure section 425.16, also known as the anti-SLAPP statute, often throws a procedural wrench into a variety of civil cases. Locked-in pleadings, an automatic stay of discovery, an immediate appeal, and mandatory attorneys’ fees often await those litigating anti-SLAPP motions. This presentation focuses on identifying claims subject to the statute, exploring the implications of this law, and counseling clients faced with anti-SLAPP issues. Twenty-five years’ worth of anti-SLAPP jurisprudence has provided much needed practical guidance for lawyers assessing the applicability of the statute where a client is suing or being sued for verbal or written statements.
