“What 25 Years of Anti-SLAPP Motions Have Taught Us”
Ruben Escobedo, Esq.

Code of Civil Procedure section 425.16, also known as the anti-SLAPP statute, often throws a procedural wrench into a variety of civil cases. Locked-in pleadings, an automatic stay of discovery, an immediate appeal, and mandatory attorneys’ fees often await those litigating anti-SLAPP motions. This presentation focuses on identifying claims subject to the statute, exploring the implications of this law, and counseling clients faced with anti-SLAPP issues. Twenty-five years’ worth of anti-SLAPP jurisprudence has provided much needed practical guidance for lawyers assessing the applicability of the statute where a client is suing or being sued for verbal or written statements.

Must every Grinius refi breed the bizarre “Branco Bump”?

How were our Supreme Court’s IRMO Moore pro tanto fractions informed by the fractions the Court had adopted only 82 days earlier in IRMO Lucas?
When representing a Separatizer, can you cite authority supporting your contention that the property’s date-of-marriage value (and not its lower purchase price) should comprise the pro tanto denominators?

When representing a Non-Separatizer, can you cite authority supporting your contention that the pro tanto fractions should ignore the unpaid mortgage balance?
